1. About NearBuy
NearBuy ("NearBuy", "we", "our", "us") is a local business discovery and visibility platform that helps customers find nearby verified businesses in Nigeria. NearBuy is not a payment processor, escrow service, or transactional marketplace. All transactions, payments, and agreements occur directly between customers and vendors outside of the NearBuy platform.
2. Acceptance of Terms
By accessing or using NearBuy — whether as a customer browsing businesses or a vendor listing your business — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use NearBuy.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate, current, and complete information during registration.
- Email verification is required to activate your account.
- One person may not maintain more than one active account. Duplicate accounts may be suspended without notice.
4. Vendor Obligations
- Vendors must list only businesses they own or are authorised to represent.
- All business information (name, address, phone, category) must be accurate and current.
- Vendors may not list counterfeit, illegal, or regulated goods without the appropriate licence.
- Vendors must respond to customer inquiries in good faith and in a timely manner.
- NearBuy may remove or suspend listings that violate our Platform Guidelines.
4a. Community Listings and Claims
- Community members (“advocates”) may create listings for real, operating businesses they genuinely recommend. Advocates must provide accurate information, the vendor's email address, the business location, and a genuine storefront photo.
- Community listings are labelled Community Listed until claimed by the business owner. The advocate may correct the listing until it is claimed.
- Business owners may claim their listing using the email it was created with, or by providing reasonable evidence of ownership, which NearBuy reviews.
- Once a listing is claimed, ownership and editing rights transfer fully to the verified owner. The advocate retains community recognition only.
- Submitting false ownership claims, or knowingly creating inaccurate or unauthorised community listings, may result in account suspension.
4b. Services, Subscriptions & Listing Activity
- Service providers: NearBuy supports product sellers, service providers, and both. Service listings may show a starting price or be quote-based. NearBuy facilitates contact and quote requests but does not process bookings or payments.
- Subscriptions: A free account includes one business listing and standard analytics. Paid plans may add store slots and improved analytics. Paid benefits never override nearby relevance or customer trust, and any future ads will be clearly identified.
- Listing activity: To keep results accurate, vendors are periodically asked to confirm their details. Listings with no meaningful activity may show an “information may be outdated” notice, lose prominence, or be hidden from normal search over time. Listings are not deleted automatically and remain claimable or restorable.
- Visit signals: NearBuy records best-effort visit signals (navigation started, likely arrival, and GPS-backed verified visits) to strengthen trust indicators. These are shown to businesses only as aggregate counts.
5. Customer Conduct
- Customers must not use NearBuy to harass, threaten, or defraud vendors.
- Customers must not submit false reviews, trust validations, or purchase proofs.
- NearBuy is a discovery platform — all commercial agreements are between you and the vendor.
- NearBuy bears no liability for goods or services transacted outside the platform.
6. Prohibited Content
The following content is strictly prohibited on NearBuy:
- Counterfeit or pirated goods
- Illegal drugs, weapons, or controlled substances
- Adult, obscene, or sexually explicit content
- Hate speech, discrimination, or content targeting protected characteristics
- Spam, phishing links, or misleading business information
- Content that infringes third-party intellectual property rights
7. Intellectual Property
NearBuy and its original content, features, and functionality are owned by NearBuy and protected by Nigerian and international copyright, trademark, and intellectual property laws. You retain ownership of content you submit (e.g., business photos) but grant NearBuy a non-exclusive, royalty-free licence to display and distribute such content on the platform.
8. Limitation of Liability
NearBuy provides its services "as is" and "as available". We do not warrant that the platform will be error-free, uninterrupted, or free of viruses. To the fullest extent permitted by Nigerian law, NearBuy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including any commercial transactions you conduct with vendors discovered through NearBuy.
9. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may close your account at any time by contacting support@nearbuy.ng. Upon termination, your right to use the platform ceases immediately.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the competent courts of Lagos State, Nigeria.
11. Changes to These Terms
NearBuy reserves the right to update these Terms at any time. We will notify users of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance.
